EMPLOYMENT LAW

Since 2018, Mr. Evans has been voted as one of the top 100 attorneys in Michigan. He is a nationally-recognized employment attorney with extensive experience representing employers in state and federal courts, administrative agencies and private arbitrations in employment-related litigation. Before opening Evans Law Group in 2015, Mr. Evans spent almost 21 years, 17 as a partner, at the AmLaw 200 firm of Honigman LLP, where he was a partner in the Labor and Employment Department and the Practice Group Leader for Honigman’s Employment Litigation, Counseling and Strategic Workforce Planning. In his almost thirty years of experience, he has tried numerous jury trials to verdict, as well as having tried other employment-based claims before administrative agencies and in private arbitrations. He has been lead defense counsel in multi-plaintiff lawsuits, punitive class actions and putative collective actions.

Mr. Evans’ litigation experience includes defending claims brought pursuant to (1) Title VII of the Civil Rights Act of 1964, as amended, for race, color, religion, sex (including sexual harassment and national origin discrimination claims), as well as retaliation claims; (2) the Pregnancy Discrimination Act; (3) the Americans with Disabilities Act; (4) 42 U.S.C. § 1981 (race discrimination); (5) the Family and Medical Leave Act; (6) the Elliott-Larsen Civil Rights Act for race, color, religion, national origin, age, sex (including sexual harassment and pregnancy) and weight, as well as retaliation claims; (7) the Persons with Disabilities Civil Rights Act; (8) the Whistleblowers’ Protection Act; (9) the Bullard-Plawecki Employee Right to Know Act; (10) the Employee Polygraph Act of 1981; (11) the Employee Polygraph Protection Act of 1988; (12) wrongful discharge in violation of Michigan’s public policy; (13) defamation (libel and slander); (14) invasion of privacy; (15) eavesdropping; (16) breach of alleged just-cause employment agreements; and (17) retaliation claims under the Occupational Safety and Health Act and Michigan’s Occupational Safety and Health Act.

Mr. Evans’ experience also includes claims under the Fair Labor Standards Act for unpaid minimum wage, unpaid overtime, challenging employees’ exempt classification and challenging an individual’s classification as an independent contractor. He has also defended claims brought pursuant to numerous states’ wage and hour laws. In addition, Mr. Evans has defended claims for unpaid commissions, including claims seeking enhanced damages and attorneys’ fees under Michigan’s Sales Representative Commission Act. He has defended personal injury claims brought under Michigan’s intentional tort exception to the Workers’ Disability Compensation Act bar, including in wrongful death actions.

His experience includes defending against executive compensation and equity-based claims, including claims based on breach of (1) executive employment agreements; (2) equity award/stock option agreements; (3) short-term and long-term incentive plans; (4) fiduciary duties; and (5) obligations to minority shareholders.

Mr. Evans has extensive experience providing preventative counseling and strategic planning related to pre- and post-employment restrictive covenant and trade secrets issues. When litigation occurs, he has significant experience prosecuting and defending claims for (1) breach of non-competition and non-solicitation agreements; (2) threatened and actual misappropriation of trade secrets under Michigan’s Uniform Trade Secrets Act; and (3) tortious interference with business relations and business expectations.

His representation of employers includes conducting in-house employment and human resources compliance seminars. Topics include pre-employment background checks, do’s and don’ts of agency charges and investigations, employee reviews and employee discipline, the Family and Medical Leave Act, the Foreign Corrupt Practices Act, harassment in the workplace, classification of individuals as independent contractors, non-competition agreements and protecting trade secrets/confidential information, effective use of severance agreements, social media in the workplace, and employment terminations without the aftermath.

Through his experience in representing employers, executive employees have sought Mr. Evans’ representation in connection with their own employment and equity interest in corporate entities, including portfolio companies owned by private equity groups. Mr. Evans negotiates executive employees’ employment agreements, equity award/stock option agreements and, when necessary, severance agreements.

MEDIA

Mr. Evans has represented media entities in successfully prosecuting state and federal FOIA lawsuits, including successfully pursuing FOIA lawsuits seeking disclosure of public records related to the former Mayor of the City of Detroit, Kwame Kilpatrick, and the FBI’s file from main headquarters related to the disappearance of Jimmy Hoffa. He has also defended claims for defamation, news gathering and invasion of privacy. He has opposed closure of court proceedings, issuance of gag orders and subpoenas served on news organizations and their reporters. He has experience conducting pre-publication and pre-broadcast screening of news stories. When on air personalities become the target of threats from the public, Mr. Evans has secured necessary court orders to protect their safety.

SPORTS LAW

In recent years, Mr. Evans has used his employment-law background to cultivate a sports law practice focused on representing amateur, professional and Olympic athletes. While at Honigman LLP, he lead the firm’s representation of NHL Enterprises for the 2013 (cancelled because of labor dispute) and 2014 Bridgestone NHL Winter Classic® held at the University of Michigan football stadium.

ARBITRATOR SERVICES

Mr. Evans is listed on the American Arbitration Association's panel of arbitrators for Employment, Entertainment and Sports arbitrations. He also is an arbitrator with the International Institute for Conflict Prevention and Resolution (CPR), listed on CPR’s panel of Distinguished Neutrals for Employment, Franchise, Sports and Michigan General Commercial. Mr. Evans also is available to be retained for private arbitrations
