Bio

Guy W. Bluff has more than 30 years’ experience in the area of construction claims preparation as a civil trial attorney primarily in the area of business, construction and engineering related litigation, claims preparation and negotiation, arbitrations and mediations. Mr. Bluff holds a Civil Engineering Degree and his Arizona EIT Registration. He is a former judge pro tem and has taught law courses at Maricopa County Community College.  He is licensed to practice in Arizona, California, Colorado, and New Mexico as well as before nearly a dozen Federal District Courts and Courts of Appeals.

During his 30+ year litigation career, Mr. Bluff has practiced before more than 200 state and federal courts, courts of appeal, and tribunals including the 9th Circuit Court of Appeals, U.S. Court of Federal Claims, ASBCA, GSBCA, IBCA, and numerous federal district and bankruptcy courts. He has authored dozens of articles, books, and is a prolific public speaker.

Since 1992, Mr. Bluff has been an arbitrator with the American Arbitration Association Construction Industry Panel of Neutrals. As a neutral, Mr. Bluff has arbitrated more than 80 matters for the AAA. As trial counsel, Mr. Bluff has handled more than 100 separate AAA arbitrations and mediations and over 150 private arbitrations and the related civil court proceedings. As a neutral, Mr. Bluff has attended more than 30 specialty courses in furtherance of his training.

From 1995 to 1996, Mr. Bluff was managing partner (Cook, Bluff, Messing, PLLC) and lead trial counsel in the Fleming Foods v Megafoods 100M+ bankruptcy and related civil litigation matters where he managed and oversaw more than a dozen attorneys conducting simultaneous litigation matters in Arizona, Nevada, California and Texas.

From 2013 through 2016, Mr. Bluff was lead counsel and responsible for litigating and strategizing numerous separate but concurrent litigation matters involving $1M+ in claims on the same project and pending before the Maricopa County Superior Court, U.S. Bankruptcy Court, and Arizona Court of Appeals. As lead counsel, Mr. Bluff had to strategize the interplay of different legal approaches so as to not adversely impact the client’s overall position.

From 2019 through 2020, Mr. Bluff acted as lead counsel on a $100M federal court and AAA arbitration matter involving various antitrust, wrongful termination, and breach of franchise claims against a national window and door manufacturer.  From 2018 to 2020 Mr. Bluff has been lead counsel on federal and state antitrust, copyright, and breach of contract claims involving more than $8M.

From 2018 to the present, Mr. Bluff has been General Counsel and Chief Compliance Officer for Dreamstyle Remodeling, Inc. one of the largest remodeling contractors in the Western United States with more than $120M in annual sales.  As trial and litigation counsel for Dreamstyle Remodeling, Mr. Bluff is responsible for managing numerous matters pending in the State Superior and Federal District Courts in CA, AZ, NM and CO.  Mr. Bluff is responsible for various real estate, insurance, employment, workers compensation, copyright and trademark, contracts drafting and negotiations for all aspects of the company's business.

As claims and litigation counsel, Mr. Bluff has developed an extensive knowledge base involving the full range of construction disputes, claim preparation, claim defense, damage analysis and cost overruns from both sides of the dispute. Mr. Bluff’s claims experience includes: changes / extra work; implied warranty of plans and specifications (Spearin); differing site conditions; scheduling related claims (delay, acceleration, disruption, suspension of work); labor and jobsite inefficiency; lost project revenue (profits, unabsorbed overhead (Eichleay / P.J Dick).
